Day 27 · Halal, Haram and the Penalties

Is the list of what Allah forbids long or short?
Today
Halal means permitted; haram means forbidden. The Quran's starting point is generous: eat of what is lawful and good (2:168). It names what is forbidden, and it condemns people who invent prohibitions and attribute them to Allah (16:116). Scholars draw a principle from this: things are lawful unless shown otherwise.
It also names a few grave wrongs with fixed penalties in this world: unlawful sex, falsely accusing someone of it, theft, armed robbery, and murder. These verses are often quoted without their conditions. Today you will read them with those conditions: strict proof, a court rather than individuals, and the door of repentance the verses themselves keep open.
Where details come from hadith and the schools of law rather than the verse, the label says so.
A sensitive topic. This lesson is a draft awaiting review by a qualified scholar; where readings differ, the main views are shown.
What the Quran says
Say, "My Lord has only forbidden immoralities - what is apparent of them and what is concealed - and sin, and oppression without right, and that you associate with Allah that for which He has not sent down authority, and that you say about Allah that which you do not know."
Context Makkah. 6:151-153 gives a longer list, and 4:31 promises that avoiding the major sins wipes away lesser ones.
The forbidden is named: indecency open or hidden, sin, oppression, associating partners with Allah, and speaking about Allah without knowledge.
He has only forbidden to you dead animals, blood, the flesh of swine, and that which has been dedicated to other than Allah. But whoever is forced [by necessity], neither desiring [it] nor transgressing [its limit], there is no sin upon him. Indeed, Allah is Forgiving and Merciful.
Context Madinah. 5:3 adds animals killed by strangling, blows or falls; 5:5 allows the food of the People of the Book.
Only a few foods are forbidden: carrion, blood, pork, and what is dedicated to other than Allah. Under real necessity, there is no sin.
O you who have believed, indeed, intoxicants, gambling, [sacrificing on] stone alters [to other than Allah], and divining arrows are but defilement from the work of Satan, so avoid it that you may be successful. Satan only wants to cause between you animosity and hatred through intoxicants and gambling and to avert you from the remembrance of Allah and from prayer. So will you not desist?
Context The last of three stages on alcohol, after 2:219 and 4:43.
Intoxicants and gambling are called defilement from Satan that breeds enmity and keeps people from prayer. Scholars read "avoid it" as a complete ban.
The [unmarried] woman or [unmarried] man found guilty of sexual intercourse - lash each one of them with a hundred lashes, and do not be taken by pity for them in the religion of Allah, if you should believe in Allah and the Last Day. And let a group of the believers witness their punishment.
Context Proof requires four witnesses to the act (24:4, 24:13) or a free confession.
Proven unlawful sex (zina) carries a hundred lashes, applied by a court without pity suspending the law.
Sahih's "[unmarried]" follows the majority, who apply stoning to married offenders from hadith in al-Bukhari and Muslim. A minority, early and modern, hold that 24:2 covers all.
[As for] the thief, the male and the female, amputate their hands in recompense for what they committed as a deterrent [punishment] from Allah. And Allah is Exalted in Might and Wise. But whoever repents after his wrongdoing and reforms, indeed, Allah will turn to him in forgiveness. Indeed, Allah is Forgiving and Merciful.
Context Madinah. The penalty is stated; its conditions come from the Sunnah and the jurists.
Applied only with firm proof, above a minimum value, from a secured place, and not under need or doubt; 'Umar suspended it in a famine. 5:39 opens repentance.
O you who have believed, prescribed for you is legal retribution for those murdered - the free for the free, the slave for the slave, and the female for the female. But whoever overlooks from his brother anything, then there should be a suitable follow-up and payment to him with good conduct. This is an alleviation from your Lord and a mercy. …
Context Reports say it ended tribal feuds where the strong took many lives for one. 2:179: in retribution there is life.
Murder is answered by equal retribution through the law, yet the victim's family may forgive and accept compensation (diyah), which the verse calls a mercy.

The key word
ḥarām · Forbidden; sacred
Something set apart and fenced off. The same root names the Sacred Mosque (al-Masjid al-Haram) and the sacred months: what is haram is protected, either because it is holy or because it harms. Its opposite, halal, comes from a root meaning to untie: released for use.
6:15116:116A common mix-up
Islamic law is mostly a list of harsh punishments that any Muslim may carry out.
Only a few fixed penalties appear in the Quran, each bound by strict proof, such as four witnesses (24:4). Classical scholars agreed they belong to a lawful court, never to individuals, and that doubt prevents them. The verses also keep repentance open (5:34, 5:39, 24:5). Most of Islamic law concerns worship, family, trade and character.
24:45:395:34Remember
Carry one verse
If you avoid the major sins which you are forbidden, We will remove from you your lesser sins and admit you to a noble entrance [into Paradise].
